1. Introduction

Welcome to HearBook ("we," "our," or "the App"). These Terms and Conditions ("Terms") govern your use of the HearBook mobile and desktop application. By downloading, installing, or using HearBook, you agree to be bound by these Terms.

2. Acceptance of Terms

By accessing or using HearBook, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

3. Description of Service

HearBook is an audiobook player application that allows you to:

Import and organize audiobook files stored on your device
Play audio files in various formats (MP3, M4A, M4B, FLAC, OGG, WAV, AAC)
Track your listening progress and create bookmarks
Organize books into custom categories
Access premium features through optional subscriptions

All audiobook files and user data are stored locally on your device. HearBook does not provide audiobook content, host files on external servers, or sync data to the cloud.

4. User Responsibilities

4.1 Content Ownership

You are solely responsible for ensuring you have the legal right to possess and use any audiobook files you import into HearBook. We do not provide content and cannot verify the source or legality of files you add to the App.

4.2 Acceptable Use

You agree to:

Use the App only for lawful purposes
Not use the App to store, share, or distribute copyrighted materials without proper authorization
Not attempt to reverse engineer, decompile, or modify the App
Not use the App in any way that could damage, disable, or impair the App's functionality

4.3 Age Requirements

You must be at least 13 years old (or the age of majority in your jurisdiction, whichever is higher) to use HearBook. If you are under 18, you must have parental or guardian consent to use the App.

5. Subscriptions and Payments

5.1 Premium Features

HearBook offers optional premium features available through subscription. Premium subscriptions are available on Android and iOS platforms via in-app purchases.

5.2 Payment Processing

All subscription payments are processed through:

Android: Google Play Store
iOS: Apple App Store
Payment Provider: RevenueCat (payment processing service)

5.3 Subscription Terms

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
Your payment method will be charged within 24 hours prior to the start of each renewal period
Subscription prices are displayed in the App and may vary by region
Any unused portion of a free trial period will be forfeited when you purchase a subscription

5.4 Cancellation and Refunds

You may cancel your subscription at any time through your App Store account settings
Cancellation takes effect at the end of the current billing period
No refunds are provided for partial subscription periods
Refund requests must be made through the respective app store (Google Play or Apple App Store)
We do not have access to process refunds directly

5.5 Free Trial

If a free trial is offered, you may be charged when the trial period ends unless you cancel before the trial expires. Trial eligibility is determined by the app stores and may be limited to one per user.

5.6 Platform Availability

Premium subscriptions and in-app purchases are only available on Android and iOS. Desktop (JVM) versions of the App do not support subscription features.

6. Intellectual Property

6.1 App Ownership

HearBook, including all source code, design elements, user interface, and documentation, is owned by BearMinds and protected by copyright, trademark, and other intellectual property laws.

6.2 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use HearBook for personal, non-commercial purposes in accordance with these Terms.

6.3 User Content

You retain all rights to audiobook files you import into the App. By using the App, you grant us no rights to your content. All files remain stored locally on your device.

7. Privacy and Data Collection

Your use of HearBook is also governed by our Privacy Policy. We collect limited analytics data to improve the App. All audiobook files and user data (bookmarks, progress, categories) are stored locally on your device and are not transmitted to our servers.

8. Third-Party Services

HearBook integrates the following third-party services:

8.1 Firebase Analytics

We use Google Firebase Analytics to collect anonymous usage statistics. This service is provided by Google LLC and is subject to Google's Privacy Policy.

8.2 RevenueCat

We use RevenueCat to process subscription payments on Android and iOS. RevenueCat is subject to its own Terms of Service and Privacy Policy.

8.3 App Stores

When you download the App through Google Play Store or Apple App Store, you are also subject to the respective store's terms and conditions.

9. Disclaimers and Limitations of Liability

9.1 No Warranty

HEARBOOK IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

The App will be error-free or uninterrupted
Defects will be corrected
The App is free from viruses or harmful components
Results obtained from using the App will be accurate or reliable

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEARMINDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

Your use or inability to use the App
Any unauthorized access to or use of your device
Any bugs, viruses, or other harmful code transmitted through the App
Any errors or omissions in content
Loss of audiobook files or user data

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE PAST SIX MONTHS, OR ONE HUNDRED EUROS (€100), WHICHEVER IS LESS.

9.3 Jurisdiction Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, the above limitations may not apply to you.

10. Data Backup

Important: You are solely responsible for backing up your audiobook files and data. While user data (bookmarks, progress, categories) is stored locally in the App's database, we recommend:

Keeping backup copies of your audiobook files
Being aware that uninstalling the App may result in loss of user data
Understanding that device resets or failures may result in data loss

We are not responsible for any data loss resulting from device failure, App deletion, or other circumstances.

11. Platform-Specific Terms

11.1 Android

The App requires WAKE_LOCK permission to keep your device awake during background audio playback
Integration with Android's "Open With" functionality allows you to import audiobook files from other apps

11.2 iOS

The App integrates with iOS's native AVPlayer for audio playback
Files can be shared with HearBook from other iOS apps

11.3 Desktop (JVM)

Desktop versions use JavaFX Media for audio playback
Subscription features are not available on desktop platforms
Some platform-specific features may differ from mobile versions

12. Updates and Modifications

12.1 App Updates

We may release updates to improve functionality, fix bugs, or add features. While we strive to maintain backward compatibility, we cannot guarantee that updates will not affect your existing data or the App's performance on your device.

12.2 Terms Updates

We reserve the right to modify these Terms at any time. When we make changes:

The "Last Updated" date at the top of this document will be revised
For material changes, we will notify you through the App or via email (if provided)
Continued use of the App after changes constitutes acceptance of the new Terms

You are responsible for reviewing these Terms periodically.

13. Termination

13.1 Termination by You

You may stop using HearBook at any time by deleting the App from your device. Remember to cancel any active subscriptions through your app store account to avoid future charges.

13.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for:

Violation of these Terms
Fraudulent, abusive, or illegal activity
Any reason at our sole discretion

13.3 Effect of Termination

Upon termination:

Your license to use the App immediately ends
You must delete all copies of the App from your devices
Active subscriptions may continue until the end of the billing period unless refunded by the app store
Termination does not affect any rights or obligations that accrued prior to termination

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

14.2 Jurisdiction

You agree that any disputes arising from these Terms or your use of HearBook shall be subject to the exclusive jurisdiction of the courts located in Gdańsk, Poland.

14.3 European Union Users

If you are a consumer located in the European Union, you benefit from mandatory provisions of consumer protection law in your country of residence, and nothing in these Terms affects your legal rights as a consumer.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BearMinds regarding the use of HearBook and supersede any prior agreements.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

16. Open Source

HearBook uses various open-source libraries and components. Acknowledgments and license information for these components are available within the App.

By using HearBook, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
